THIS PART IMPLEMENTS THE REQUIREME IN SECTION 701(28), P.L. 95-87 WHICH REQUIRES THE REGULATORY AUTHORITY TO MAKE A DETERMINATION OF EXEMPTION TO THE ACT FOR OPERATORS EXTRACTI LESS THAN 16 2/3 TONNAGE OF COAL INCIDENTAL TO OTHER MINERALS. THIS INFORMATION WILL BE USED BY THE REGULATORY AUTHORITY TO MAKE THAT DETERMINATION.
