In accordance with the Paperwork Reduction Act (PRA) and 5 CFR 1320, OMB cannot approve the addition of NOx increments to the existing Prevention of Significant Deterioration (PSD)/New Source Review (NSR) information collection request (ICR). On February 8, 1988, EPA published a proposed rulemaking to establish a PSD program for NOx. The notice proposed an increment scheme similar to that established by congress for PM and SO2. The notice solicited comment on the appropriate PSD increment for NOx and other regulatory schemes that would satify the congressional mandate. Until a final PSD program is selected, OMB cannot determine if the information collection meets the requirements of the PRA and 5 CFR 1320. Thus it would be premature for OMB to approve this ICR at this time.

ALL NEW SOURCES AND MODIFICATIONS OF AIR POLLUTION MUST SUBMIT ESTIMAT OF EMISSIONS, PROPOSED CONTROL TECHNOLOGY, AND AIR QUALITY IMPACT BEFO COMMENCING CONSTRUCTION SO THE APPROPRIATE REVIEWING AUTHORITY CAN ENSURE THAT THE CONSTRUCTION WILL COMPLY WITH PART C, PART D, AND SECTION 110 OF THE CLEAN AIR ACT.
