Abstract:
THE CLEAN AIR ACT AUTHORIZES EPA TO ISSUE REGULATIONS SPECIFYING THE PROVISION OF THE CAA FOR WHICH INDIAN TRIBES MAY BE TREATED IN THE SAM MANNER AS STATES. THE PROPOSED RULE WOULD GRANT TRIBES, WITH EPA APPROVAL, CAA PROGRAM AUTHORITY OVER ALL AIR RESOURCES WITHIN THE EXTERIOR BOUNDARIES OF THE RESERVATION, INCLUDING NON-INDIAN OWNED FEE LANDS.
