This ICR is not approved at this time for the following reasons: 1) EPA has not demonstrated that the proposed collection of information reduces to the extent practicable and appropriate the burden on affected persons (5 CFR 1320.9(c)). For example, EPA would require the retention of ALL records pertaining to data supporting a determination of whether a waste is restricted, as opposed to some summary or subset of the information. 2) The agency has not analyzed or accounted for the burden associated with the requirement of 40 CFR 261.4(b)(7) that the "owner or operator must be able to document that the co- processing of hazardous secondary materials does not significant- ly affect the residues..." etc. 3) No accounting was given of the cost burden, even though some testing equipment would seem necessary. (5 CFR 1320.3(b)) 4) We would also note that this ICR was submitted to OMB after the date of publication of the Notice of Proposed Rulemaking in contravention of 5 CFR 1320.11(b). In its final rulemaking EPA should address these comments as well as any comments received from the public during the extended comment period and should clearly demonstrate both the practical utility of this information collection and its use of the least burdensome methods available as required by 5 CFR 1320.
