This ICR is approved for 18 months under 5 CFR 1320. OMB has had a number of longstanding concerns with the practical utility of this ICR (see previous Terms of Clearance) and requests that EPA fully evaluate the practical utility in the next revision. The next revision will be opportune to assess any and all of the the recordkeeping and reporting requirements; first, EPA just completed an analysis of the effectiveness of the SPCC program in preventing spills (dated July 1996); secondly, EPA is now undertaking a reassessment of the SPCC program, including the ICR, and has told OMB it expects to complete it during 1997. This reassessment will give EPA the opportunity to assess the effectiveness of the program and how best to design recordkeeping and reporting requirements that have practical utility and are the least burdensome necessary, among other things. Among the factors OMB hopes EPA will address in its next ICR revision are a number of issues raised by public commenters in this review: consolidating multiple plans that facilities have to prepare under different regulations into a single facility response plan, (e.g. as part of an Integrated Contingency Plan); expanding the exemption for SPCC applicability for underground storage to 84,000 gallons to avoid duplicative regulatory requirements under 40 CFR 280 and 40 CFR 112; the need to apply SPCC ICR requirements on facilities contanining oil-filled electrical equipment. In addition, when EPA provides public notice in the Federal Register of a 60-day comment period prior to submission for OMB review, as per 1320.8(d), EPA shall summarize in that notice the key findings of the July 1996 report on SPCC effectiveness, announce public availability on the report, and request comment on the report during the ICR review. OMB believes it is important for the public to have the opportunity to review the results of EPA's July 1996 report to allow a proper evaluation of the practical utility of the SPCC ICR.
