As agreed upon after discussions with EPA, the ICR was approved for a three-year period with the following terms of clearance. Before the next review of the ICR, EPA shall perform an evaluation of the National Roster for Environmental Dispute Professionals. EPA shall consult with OIRA regarding the details of the evaluation design. The evaluation shall include, at a minimum, the following subjects. Roster Composition 1. Number of people on the roster, tabulated by organizational affiliation (non-profit, ADR firm, law firm, etc.) 2. Rate of failure of applicants to the roster. 3. Analysis of those who failed to qualify. The analysis should break down those failing to qualify by score into subgroups of 50-64 points, 0-49 points. The analysis should include applicants' organizational affiliation (non-profit, etc.) as well as score. Roster Use 1. Number of people calling the Institute for assistance with using the roster to develop a panel of mediators, subdivided by agency (EPA regions, EPA headquarters, other Federal agencies, state/local government agencies, other). 2. Number of people accessing the roster electronically to develop a panel of mediators, subdivided if possible by agency. 3. Estimate of the percentage of environmental disputes mediated by EPA that use a mediator who is on the roster. 4. Estimate of the percentage of environmental disputes mediated by other Federal agencies that use a mediator who is on the roster. 5. Estimate of the percentage of environmental disputes mediated by state/local agencies that use a mediator from the roster, if possible.
