Abstract:
The proposed rule, 10 CFR Parts 2, 30, 40, 50, 52, 60, 63, 70, 71, 72, 73, 76, and 150, "Protection Of Safeguards Information" would amend NRC regulations for the protection of Safeguards Information (SGI) and add requirements for Safeguards Information for modified handling (SGI-M) to protect SGI and SGI-M from inadvertent release and unauthorized disclosure which might compromise the security of nuclear facilities and materials. The proposed amendments would affect certain licensees, information, and materials not currently subject to SGI regulations, but which are within the scope of Commission authority under the Atomic Energy Act of 1954, as amended (AEA). The NRC originally published the proposed rule in the Federal Register on February 11, 2005 (70 FR 7196). The NRC is again publishing the proposed rule on SGI in order to allow the public to comment on changes to the rule text. These changes are in response to public comments and amendments to the AEA in the Energy Policy Act of 2005 (EPAct) and Commission Orders issued to licensees authorized to possess and transfer items containing certain quantities of radioactive material.

Short Statement:
The burden would increase by 4,741 hours from 524,820 hours to 529,561 hours due to additional licensee requirements to perform background checks, including fingerprinting for criminal history checks. The burden was estimated to be 4,515 hours for the orignial proposed rule, as it was published in 2005. The burden has increased from this estimate because of the requirement in section 652 of the EPAct for licensees, applicants, certificate holders, and permittees to perform background checks (including fingerprinting for criminal history checks) before an individual is permitted access to SGI. Following receipt of comments for the proposed rule in 2005, the number of power reactor recordkeepers was decreased in response to NEI comments. The number of other licensees and applicants subject to ยง 73.23 was decreased as a result of more accurate information being available.
