Abstract:
On April 5, 2006, the FCC adopted the Report and Order and Third Order on Reconsideration. The final rules modify the Commission's rules on unsolicited facsimile advertisements to implement the Junk Fax Prevention Act of 2005. The reporting and recordkeeping requirements are the best means of implementing the Junk Fax Prevention Act and preventing unsolicited fax advertisements.

Short Statement:
The increase in the burden for this information collection is due solely to the adoption on April 5, 2006 by the FCC of a Report and Order and Third Order on Reconsideration, In the Matter of Rules and Regulations Implementing the Telephone Consumer Protection Act of 1991; Junk Fax Prevention Act of 2005, CG Doc. No. 02-278 and 05-338; FCC 06-42, which adopted final rules to implement the Junk Fax Prevention Act. Among other things, the Commission created FCC Form 1088 that is designed specifically for collecting complaint data regarding junk faxes, unsolicited email messages, and telemarketing calls. By collecting such data in a single, comprehensive template, the FCC Form 1088 will provide a standardized way for consumers to file complaints, reducing or eliminating the need for further documentation or questions from Commission investigators to determine whether violations have occurred. FCC Form 1088 may ultimately become the foundation for enforcement actions and/or rulemaking proceedings, as appropriate.
