Abstract:
Title V of the Clean Air Act requires States to develop and implement a program for issuing operating permits to all sources that fall under any Act definition of "major" and certain other non-major sources that are subject to Federal air quality regulations. The Act further requires EPA to develop and implement a Federal operating permits program for sources that are not under the jurisdiction of any State program (such as sources in Indian country, Outer Continental Shelf sources, and Deepwater ports) and in any State that does not adequately administer and enforce its State program. The EPA regulations setting forth this Federal operating permits program are codified at 40 CFR part 71. In implementing title V of the Act and EPA's part 71 operating permit regulations, EPA must act as the permitting authority and fulfill all the title V requirements that otherwise apply to State and local permitting authorities. Sources subject to the program must prepare operating permit applications and submit them to the EPA (section 503). The EPA will then issue permits (section 503(c)) and thereafter enforce, revise, and renew those permits at no more than 5-year intervals (section 502(b)(5)). The permit and all information submitted by a source shall be available for public review except for confidential information which will be protected from disclosure (section 503(e)) and the public shall be given public notice of, and an opportunity for comment on, permit actions (section 502(b)(6)). Sources will submit monitoring reports semi-annually and compliance certification reports annually to EPA (section 503(b)(2)).
