Abstract:
These regulations comprise the existing provisions of the Student Asisstance General Provisions guidance regarding cash management. Information collection under these regulations relates to cash management requirements and practices for institutions participating in the Title IV, Higher Education Act (HEA), programs. This request is for approval of reporting and recordkeeping requirements contained in the attached final regulations related to the administrative requirements of the Regulations Governing the Student Assistance General Provisions as revised by the TEACH Grant final regulations. The information collection requirements in these regulations are necessary to determine eligibility to receive program benefits and to prevent fraud and abuse of program funds.
Emergency Justfication:
The U.S. Department of Education (the Department)requests that OMB grant an emergency clearance of the changes made to OMB Control Number 1845-0038 as a result of new burden associated with regulatory changes made to 34 CFR 668.165. Under 34 CFR 668.165, institutions are required to provide written notice to recipients of Teacher Education Assistance for College and Higher Education (TEACH) Grants to notify the recipient of when and the amount of their TEACH Grant disubursements. The notice also tells the recipent of their right to cancel or reduce the amount of the TEACH Grant, as well as the procedures the institution has adopted for the recipient to contact the school about cancellation or reduction of the grant. These regulatory changes and the additional increased burden to schools and individuals are the result of comments made by the public in response to the Notice of Proposed Rulemaking published in the Federal Register on March 21, 2008. (See 73 FR 15336) The TEACH Grant Program was establised under the HEA by the college Cost Reduction and Access Act of 1007 (the CCRAA). In accordance with section 420O of the CCRAA, the effective date for the TEACH Grant Program is July 1, 2008. The Department is requesting an emergency clearance of the TEACH Grant regulations because the regular clearance process would not enable us to make an OMB-approved TEACH Grant available to applicants by the statutory effective date for the TEACH Grant Program. The Dapartment requests emergency clearance of the revised OMB 1845-0038 by June 12, 2008. The proposed TEACH Grant regulations were published on March 21, 2008. The TEACH Grant final regulations are scheduled to be sent to the Federal Register on June 16, 2008.
