Abstract:
Section 221 (a) of Title II, Chapter 2 of the Trade Act of 1974, as amended by the Trade Act of 2002, authorizes the Secretary of Labor and the Governor of each State to accept petitions for certification of eligibility to apply for adjustment assistance. The Forms ETA 9042A, Petition for Trade Adjustment Assistance and Alternative Trade Adjustment Assistance, and its Spanish translation, Form 9042a-1, Solicitud De Asistencia Para Ajuste, establish a format that may be used for filing such petitions. The Departments regulations regarding petitions for worker adjustment assistance may be found at 29 C.F.R. § 90. The Forms ETA 9043a, Business Confidential Data Request, ETA 8562a, Business Confidential Customer Survey and ETA 9118, Business Confidential Non-Production Questionnaire are undertaken in accordance with Sections 222, 223 and 249 of the Trade Act of 1974, as amended by the Trade Act of 2002, are used by the Secretary of Labor to certify groups of workers as eligible to apply for worker trade adjustment assistance.

Short Statement:
The Form ETA 9118, currently approved under OMB Control No. 1205-0447, was revised and is consolidated in this data collection (an adjustment of +1,943 hours); consequently, OMB Control No. 1205-0447 will be discontinued. The Form ETA 9018, formerly part of this collection, is being discontinued because of non-use (a program change of -225 hours). The remaining reduction in burden hours results from declining activity. Thus, the total net burden hour decrease is 3,234 hours. Despite the reductions, the current calculations correct an inadvertent error; in the previous submission, the total number of respondents and responses was counted as the total number for the ETA-9042a alone. This submission provides the correct, larger number of unique respondents (13,200) for all the forms now included under this OMB control number.
