Abstract:
The Energy Independence and Security Act of 2007 amends the Clean Air Act section 211(o) to require EPA to propose new, expanded regulations for renewable fuels (i.e. RFS2). Because the RFS2 program covers parties that were not covered by RFS1 (e.g. RFS1 covered only gasoline refiners and RFS2 covers diesel refiners as well; RFS1 had one type of program credit [RIN] to account for and RFS2 has four types of program credit [RINs] to account for), we are proposing a new ICR series. As part of this proposed ICR, we are proposing to initiate an EPA Moderated Trading System for RINs. RINs are the basic compliance unit, or credit, for this program. This System would utilize the Central Data Exchange (CDX) and would permit more reliable, electronic generation and trading of RINs. RFS2 reporting will replace RFS1 reporting when the program is fully implemented.
