Abstract:
The data collectd will be used as the application for LIHEAP block grant funding to determine the state, tribal and territorial grantees of LIHEAP funds for each fiscal year in order to carry out the requirements of Section 2605(b) of the LIHEAP statute.
Emergency Justfication:
States, Territories, and Indian Tribes/Tribal organizations that wish to administer a Low Income Home Energy Assistance Program (LIHEAP) must submit an application for funds each year. Section 2605(c)(3) of the Omnibus Budget Reconciliation Act of 1981, as amended, provides that not later than April 1 of each fiscal year, the Secretary shall make available a model LIHEAP plan which may be used, at the option of each grantee, to prepare the application required under Sections 2605(a)(1) and (c)(1). Presidential Executive Order 13520, Reducing Improper Payments and Eliminating Waste in Federal Programs, issued in November 2009, encourages Federal agencies to take deliberate and immediate action to eliminate fraud and improper payments. Additionally, as part of a review of programs subsequent to this executive order, HHS has determined that additional information from each administering agency is necessary to assess grantee measures that are in place to prevent, detect and address waste, fraud and abuse in LIHEAP programs. The LIHEAP Model Plan, OMB Number 0970-0075, currently expires on 12/30/10. The plan must be submitted by grantees annually on or before September 1 of each year in preparation for funding in the upcoming fiscal year that begins on October 1. Therefore, the Administration for Children and Families (ACF) cannot reasonably comply with the normal clearance procedures for a plan supplement, since the requested information is needed from grantees by September 1, 2010. The need has been precipitated by the unanticipated event of Executive Order 13520. Because we are asking grantees to submit additional information on the LIHEAP Program Integrity Assessment and Plan, as a supplement to the LIHEAP Model Plan beginning on September 1, 2010, we are requesting an expedited clearance from OMB. We need the clearance in sufficient time to notify grantees of our request for the completion of LIHEAP Program Integrity Assessment and Plan, so that they will be able to submit it with the LIHEAP Model Plan by September 1, 2010. In order to plan for the timely submission and review process of Fiscal Year 2011 LIHEAP applications, including the Program Integrity Assessment Supplement, ACF is requesting an expedited clearance process for Action Transmittal Number, LIHEAP-AT-2010-6, which will transmit the LIHEAP Program Integrity Assessment and Plan to grantees. We plan to make this request to grantees after OMB provides clearance. The attached Federal Register notice details the information we are requesting grantees to include in the LIHEAP Program Integrity Assessment and Plan. To give sufficient time for grantees to complete their responses to the ACF, we ask that OMB expedite their review of the information collection through emergency processing and give us clearance by May 31, 2010.
