Abstract:
10 CFR Part 73, Requirements for Fingerprint-Based Criminal History Records Checks For Individuals Seeking Unescorted Access to Research or Test Reactors, Proposed Rule The NRC is proposing to amend its regulations to require fingerprint-based criminal history records checks for RTR licensees to grant individuals unescorted access to their facilities. This action is necessary to comply with the requirements of Section 652 of the EPAct of 2005, which amended Section 149 of the AEA, to require fingerprinting and an FBI identification and criminal history records check of any person who is permitted unescorted access to a utilization facility. As a result of this action, RTR licensees would be subject to the fingerprinting and criminal history records check requirements specified in the NRCs regulations instead of NRC issued Orders EA-07-074 and EA-07-098 pertaining to this matter. The estimated recordkeeping and reporting burden of the proposed rule is 690 hours (240 hours recordkeeping plus 450 hours reporting). The 240 annual hours recordkeeping and 450 annual hours reporting were approved by OMB on June 24, 2008, as a representation of the estimated annual cost to industry under the Orders. As a result, this rule represents no increase in burden to licensees: they are already conducting these activites under Orders.
