Abstract:
In accordance with Sections 1103 and 10102 of The Patient Protection and Affordability Care Act, P.L. 111-148 (PPACA) the U.S. Department of Health and Human Services (DHHS) is tasked with developing and implementing an Internet website portal to assist consumers with identifying affordable and comprehensive health insurance coverage options that are available in their State. We are requesting approval to implement this information portal for the collection of information to assist consumers in making educated decisions on their health care options. This is an emergency request for a six month period until additional details are determined and a more comprehensive system is developed.
Emergency Justfication:
In accordance with Section 1103 of The Patient Protection and Affordability Care Act, H.R. 3590 (PPACA) the U.S. Department of Health and Human Services (DHHS) is tasked with developing and implementing an Internet website portal to assist consumers with identifying affordable and comprehensive health insurance coverage options that are available in their State. The statute requires the web portal to be functioning by July 1, 2010, and to include "premium rates, and cost sharing with respect to such coverage options." In order to meet the statutory requirement, CMS published an IFR on May 5, 2010 (75 FR 24470) that described a two phased collection and launch. Phase one involved an initial launch of the web portal on July 1 with basic coverage information, using limited data collected in May 2010. Phase two involves an October 1, 2010 update of the web portal to include extensive benefit and pricing data collected by September 3, 2010. The collection is being executed through a contractor, which required a competitive procurement process. The contract was awarded on July 26, 2010, at which time we were able to obtain the data collection templates necessary to develop the PRA package. Due to the urgency and short time frames associated with the second data collection, OCIIO does not have sufficient time to allow for the usual comment timeframe required in the PRA process. We are requesting an Emergency Review for the second phase. We will take all comments under advisement; however, due to the aggressive training and data collection timeline, we will not be able to formally accept or implement suggested changes until after October 1, 2010. We also request that OMB review be completed by August 10, 2010 to allow us to begin training on August 16, 2010 for the collection. OCIIO intends to submit for approval, prior to the expiration of this emergency PRA package to obtain the full three-year approval for the continued collection of updated data as well as an annual update structure premised on July 1st of each year for tool changes.

The burdne increase is the result of the implementation of the second phase of the informaiton collection request. The burden increased due to an increase in the number of data elements and information collection requirements. Specifically, the changes added in Appendix G, increased the burden.
