Abstract:
This request is for a new control number for new uses and burdens for BLM Form 3160-5 (Sundry Notices and Reports on Wells) that are part of a proposed rule. Form 3160-5 is approved under control number 1004-0137. Upon approval of a new control number for the new uses and burdens, and upon finalization of the proposed rule, the BLM intends to request merger of the new control number with control number 1004-0137. The proposed rule at issue here would amend the BLM's existing oil and gas operations regulations to more thoroughly address well stimulation operations, including hydraulic fracturing, on Federal and Indian lands. The proposed rule would require operators to use existing Form 3160-5 to seek the BLM's approval for all well stimulation operations, routine or nonroutine, on Federal and Indian lands. The proposal would have to include detailed information about the stimulation fluid an operator is proposing for use on Federal and Indian lands, including the chemical makeup. The rule would also require operators to use Form 3160-5 to submit information about actual well stimulation operations and identify how actual operations may have varied from those proposed. Finally, the proposed rule includes a provision authorizing operators to request a variance exempting them from requirements in the new regulations. The proposed rule would encourage operators to use Form 3160-5 for seeking a variance.
