Terms of Clearance:
OMB approves this IRS information collection request with the following terms of clearance: IRS revisions to its 2010 and 2011 Form 990 Schedule H were not submitted for OMB approval and therefore were in violation of the Paperwork Reduction Act (PRA). Per OMBs request, IRS submitted the collection for emergency review and approval. While a public comment period is not required for such emergency submissions, given significant public interest in Schedule H and Affordable Care Act-related changes, OMB asked IRS to seek public comment on the collection for 7 days or by May 16, 2012. As some hospitals need to meet a May 15, 2012 filing deadline, IRS requested OMB approval by May 15, 2012. While the filing deadline did not allow for a full consideration of public comments, IRS shall continue to consider any public comments received on this collection on or after May 15, 2012 in its next renewal and/or revision submission to OMB. The violations will also be reported in OMBs Information Collection Budget Report to Congress.

Abstract:
Form 990 is needed to determine that IRC section 501(a) tax-exempt organizations fulfill the operating conditions within the limitations of their tax exemption.
Emergency Justfication:
Schedule H is directly related to the Affordable Care Act and has changed significantly since this collection was previously approved by OMB. Due to this schedules high profile and importance, we are requesting that this revision be approved as soon as possible.

Schedule H has been complety redesigned. See supporting statement, Question 15, for details, and the 2010 version of Schedule H is included as a supplementary document for comparison. The changes result in a net increase of 55,177 burden hours. IRS has published a special 7-day notice for comment on May 9, 2012, 77 FR 27281.
