Abstract:
The Federal Family Educational Loan (FFEL) Program proposed regulations revise current regulations in areas of program administration. First, the proposed regulations indicate the regulatory changes made in the provisions related to forbearance, reasonable and affordable loan rehabilitation, and administrative wage garnishment along with the associated changes in burden. Second, the proposed regulatory changes describing the removal unneeded FFEL regulations as a result of the Student Aid and Fiscal Responsibility (SAFRA) Act which, as of July 1, 2010, terminated the authority for lenders to make new loans under the FFEL program. These circumstances require a change in the current burden hours.

Short Statement:
The Department is requesting revision to the current FFEL Program information collection under OMB 1845-0020 to reflect the statutory and regulatory changes to the program. The proposed regulations modify forbearance provisions, reasonable and affordable loan rehabilitation processes, and a number of provisions affecting administrative wage garnishment provisions. Substantial regulatory changes and burden reduction would be made due to the proposed repeal of unneeded FFEL regulations as a result of SAFRA which was included in the Health Care and Reconciliation Act of 2010. This terminated the authority of lenders to make new loans under the FFEL program.
