The Truth in Negotiations Act, 10 U.S.C. 2306a and 40 U.S.C. 254(d), require that the Government obtain certified cost or pricing data from contractors prior to the award of certain contract actions. Contractors may be exempt from this requirement under certain conditions.

Short Statement:
The information collection requirements in the FAR remain unchanged. While the average hourly burdened rate from the previously approved information collection has increased to $49.36 from $48.00, a reduction in Government contracting has resulted in both a reduction in the annual hour burden from 10,101,684 to 9,731,560 and the annual overall cost from $9,575,445 to $9,224,694 to the public.

On behalf of this Federal agency, I certify that the collection of information encompassed by this request complies with 5 CFR 1320.9 and the related provisions of 5 CFR 1320.8(b)(3).
