OMB preapproves this information collection request, which is associated with the Total and Permanent Disability Discharge of Loans interim final rule (84 FR 65000). The Department of Education may activate this approval only after the final rule has published in the Federal Register. The final rule must respond to public comments received in response to the IFR and explain any changes that were or were not made in response to those comments. Activating this approval prior to the publication of a final rule would violate the Paperwork Reduction Act and is not permitted.

Abstract:
The Discharge Application: Total and Permanent Disability serves as the means by which an individual who is totally and permanently disabled, as defined in section 437(a) of the Higher Education Act of 1965, as amended, applies for discharge of his or her Direct Loan, FFEL, or Perkins loan program loans, or TEACH Grant service obligation. The form collects the information that is needed by the U.S. Department of Education (the Department) to determine the individual's eligibility for discharge based on total and permanent disability. The Department, through an Interim Final Rule, is amending the regulations for the Federal Direct Loan Program, the Federal Family Education Loan Program, and the Federal Perkins Loan Program to remove unintended administrative barriers for veterans who are entitled to a student loan discharge due to a service-related total and permanent disability and requesting a revision to the current information collection.

The decrease 5,000 burden is to respond to the new regulatory language which allows the Department to process a total permanent discharge for veterans for whom the Department has received information about a total and permanent disability from the Department of Veteran Affairs.
