Short Statement: The reduction in the estimated hour burden from 9,102 hours to 8,532 hours is primarily attributable to the fact that the additional respondent clearing agency subject to Rule 17Ad-22(e) under the amended definition of “covered clearing agency” has already incurred all of the initial burdens associated with the applicable provisions of Rule 17Ad-22(e) and the Commission staff now expects that only one new respondent, instead of two, will register in the next three years. As a result, the initial burden estimates for many of the provisions in Rule 17Ad-22(e) are now lower compared to those provided in the PRA analysis that was submitted in connection with the 2020 Adopting Release and partial revision. In addition, the PRA burdens associated with Rule 17Ad-22(d) have been reduced to reflect a decrease in the number of respondents that will be subject to the rule. With the adoption of the amendments to Rule 17Ad-22(e), one of the three registered clearing agencies subject to Rule 17Ad-22(d) became a covered clearing agency subject to Rule 17Ad-22(e). As such, the Commission staff believes that only two respondent clearing agencies will remain subject to the PRA burdens associated with Rule 17Ad-22(d), and the aggregate burden estimate for Rule 17Ad-22(d) has been adjusted accordingly. There has been no change in the estimated cost burden.
