Abstract:
30 U.S.C. 811(a)(7) requires, in part, that mandatory standards prescribe the use of labels or other appropriate forms of warning as are necessary to ensure that miners are apprised of all hazards to which they are exposed, relevant symptoms and appropriate emergency treatment, and proper conditions and precautions for safe use or exposure. MSHA’s hazardous communications (HazCom) standards in 30 CFR 47 require mine operators to evaluate the hazards of chemicals they produce or use and to provide information to miners concerning chemical hazards by means of a written HazCom program including a list of all hazardous chemicals known at the mine, labeling containers of hazardous chemicals, providing access to Material Safety Data Sheets (MSDS) and administering initial miner training.

Short Statement:
Respondents: The number of respondents decreased from 15,584 to 15,021 mining operations. Responses: The number of responses decreased from 907,408 to 621,433 due to a decrease in the number of respondents and a reclassification in how responses are calculated in Table 12-3. Instead of treating containers as the responses, labels are treated as responses. Burden Hours: The number of burden hours decreased from 148,235 to 146,902 due to a decrease in the number of respondents. Respondents or Recordkeeping Costs: The estimated annual costs increased from $9,175 to $55,254 due to a change in which recordkeeping costs are included in Table 13-5. Recordkeeping costs relating to providing copies of HazCom information to miners or their representatives are not included given that this action is not required by 30 CFR 47.71. Instead, recordkeeping costs relating to providing copies of label information and MSDS to customers are included given that this is required by 30 CFR 47.73.
