        <RULE_TITLE>Direct Final Amending Monitoring Requirements of the New Source Performance Standards (NSPS) for Steam Generating Units</RULE_TITLE>
        <ABSTRACT><![CDATA[EPA is issuing direct final amendments (and the corresponding parallel proposal) of the monitoring requirements in the electric utility and boiler New Source Performance Standards (NSPS). Since promulgation of the 2009 final amendments, EPA has issued an information collection request (ICR) to the electric utility sector that requires condensable particulate matter (PM) testing from a substantial number of units. We have determined that this ICR will provide sufficient data to determine both if a standard is appropriate, and, in the event a standard is appropriate, the level of the standard. Therefore, the testing requirement in the NSPS is no longer necessary and represents an unnecessary burden to the regulated community. Consequently, the direct final would eliminate the testing requirement. In addition, questions about the intent of the 2009 amendments to the opacity monitoring requirements and been raised, and the direct final amendments specify a date by which the amended opacity monitoring requirements must commence. Finally, the direct final amendments will correct 3 recently identified errors in the regulatory text.]]></ABSTRACT>
