Title: ●Voluntary Public Access and Habitat Incentive Program 
Abstract: We are adding a new regulation in 7 CFR part 1400 to implement the new Voluntary Public Access and Habitat Incentive Program (Public Access), which was authorized by the 2008 Farm Bill. Public Access is a voluntary public access program under which State and tribal governments may apply for grants to encourage owners and operators of privately held farm, ranch, and forest land to voluntarily make that land available for access by the public for wildlife-dependent recreation including hunting or fishing under programs administered by State and tribal governments. Grant applications must describe the benefits that the State or Tribal government intends to achieve by encouraging public access for hunting, fishing, and recreational purposes and the methods used to achieve those benefits. Priority-selection factors include grant applications that: (1) Provide for widespread acceptance by landowners; (2) ensure there is appropriate wildlife habitat; (3) strengthen wildlife habitat improvement efforts under Conservation Reserve Enhancement Program (CREP); (4) propose to use additional Federal, State, tribal government or private resources; and (5) make available to the public the location of the enrolled land. Grants will be reduced for States that have inconsistent migratory bird hunting dates applicable to residents and non-residents.
