Abstract: The Department is publishing this rule to implement the statutory requirement and effective date. Although section 701 states the Department "may" authorize forensic examinations following a sexual assault or domestic violence, section 1079(a) of title 10, United States Code, states the Department shall contract for such services described in the section and the types of health care shall be the same as authorized in military medical treatment facilities, thereby creating an entitlement to these services. The entitlement includes forensic examination following sexual assault or domestic violence provided in civilian health care facilities (e.g., civilian rape crisis facilities). | |
