Title: Notification of Arrival in U.S. Ports; Certain Dangerous Cargoes; Electronic Submission (USCG-2004-19963) 
Abstract: This rulemaking project would permanently revise the Notice of Arrival (NOA) regulation, 33 CFR part 160, subpart C, by: 1) Adding to the list of certain dangerous cargo (CDC) ammonium nitrate and certain ammonium nitrate-based fertilizers, in bulk, as well as propylene oxide, alone or mixed with ethylene oxide, in bulk; 2) adding two options for vessels to submit NOAs electronically, and 3) and define CDC residue. In addition, the rulemaking would clarify that foreign, but not U.S., recreational vessels must submit NOAs. This rulemaking would also permanently revise 33 CFR parts 104 and 105 as necessary. This project supports the Coast Guard's strategic goals of maritime safety, maritime security, and protection of natural resources. Market or Regulatory Failure Analysis: This rulemaking clarifies that certain chemicals would no longer be classified as CDC if found in residual amounts after cargo has been transferred. The justification for the regulation is the improved functioning of government and lifting a burden on the affected economic sector.
