Title: Market-Based Rates for Wholesales Sales of Electric Energy, Capacity and Ancillary Services by Public Utilities 
Abstract: The Commission denied rehearing of most determinations made in the Final Rule. The Commission granted rehearing: (1) Concerning the finding that Northern PSEG is a submarket within PJM; (2) regarding the adoption of a two-way information sharing restriction, finding that a one-way information sharing restriction adequately protects captive customers; and (3) by modifying the Commission’s policy with respect to mitigation of long-term transactions. The Commission also clarified: (1) The Commission’s use of historical data in market power analyses; (2) that sellers are not required to report on financial transmission rights as part of the vertical market power analysis; (3) questions that have arisen concerning the implementation process adopted in the Final Rule; (4) the change in status reporting requirement; and (5) concerning the impact of existing mitigation in RTO/ISOs.
