Title: Federal Plan Requirements for Other Solid Waste Incineration Units Constructed On or Before December 9, 2004 
Abstract: In this OSWI Federal plan rulemaking, EPA becomes an implementing authority in those instances where the State or local agency has failed to submit a plan or a plan has not yet been approved. Therefore, consistent with section 129(b)(3) of the Act, this rulemaking would impose a Federal plan that applies to OSWI in any State, tribe, or locale that has not submitted an approvable plan within the time allotted. When the State submits an approvable State Plan, the Federal plan will no longer apply to units in that State.
