Title: ●Implementing the 8-hour Ozone National Ambient Air Quality Standard: NSR Anti-Backsliding 
Abstract: This rulemaking action will provide an NSR and section 185 penalty fee component to a soon-to-be- proposed rule for implementation of the 8-hour ozone national ambient air quality standard (NAAQS) to address a partial vacatur by the U.S. Circuit Court of Appeals for the District of Columbia Circuit. The action will address anti-backsliding aspects of the court decision as they apply to nonattainment areas that the implementation rule originally covered under Clean Air Act (CAA) title I, part D, subpart 1. The court decision specified reinstatement of NSR requirements and section 185 penalty fee requirements from the revoked 1-hour NAAQS, but left unanswered the conditions under which those requirements were to be applied. This action will answer questions left open by the court.
