Title: Environmental Review of Activities that Support the Deployment of ITS Projects 
Abstract: Pursuant to SAFETEA-LU, this rulemaking would establish categorical exclusions from the requirement that an environmental assessment or an environmental impact statement be prepared under section 102 of the National Environmental Policy Act of 1969 (NEPA) for (1) activities that support the deployment of intelligent transportation infrastructure and systems and (2) the purchase of railroad right-of-way. Further, this rulemaking asks for comment on the potential addition of one or more new categorical exclusions for projects that reduce transportation system congestion. This rulemaking also seeks to resolve inconsistencies between the regulation and the new 23 U.S.C. 139, created by section 6002 of SAFETEA-LU. Finally, the rulemaking proposes to update the regulation to reflect changes in the law and agency practice over the years, and make minor additions and changes to the list of categorical exclusions.
