Title: FMVSS No. 126, Electronic Stability Control Reconsideration 
Abstract: This rulemaking would respond to petitions for reconsideration of FMVSS No. 126, which requires that electronic stability control be phased in for vehicles with GVWRs no greater than 10,000 pounds beginning September 1, 2008, with completion by September 1, 2011. The preamble would clarify that the two-part ESC OFF telltale described by Porsche and a multifunction ESC control described by Alliance of Automobile Manufacturers are permitted by the existing standard. The regulatory text would be amended to clarify the malfunction telltale test procedure, to raise the minimum active speed of ESC to 20 km/h, and to change the default ESC mode when certain off-road 4 wheel-drive configurations have been selected. These changes would avoid the loss of carry-forward credits to manufacturers for vehicles currently being manufactured. This rulemaking would also deny the petition by the American Association for Justice to require roll stability control in addition to the current requirement of ESC for yaw stability control.
