Title: Supportive Housing for the Elderly and Persons With Disabilities (FR-5167) | |
Abstract: This proposed rule would amend HUD's regulations governing capital advances for the following two programs: Section 202 Supportive Housing for the Elderly and section 811 Supportive Housing for People With Disabilities. This rule proposes to provide an exception to the conflicts of interest provisions in capital advance regulations. Current regulations specify that certain contracts between the owner, the legal owner of the housing for the elderly or persons with disabilities and the sponsor, the nonprofit entity sponsor's nonprofit affiliate, will not constitute a conflict of interest if no more than two persons salaried by the sponsor or management affiliate serve as non-voting directors on the owner's board of directors. This rule amends current regulations to include an exception to the conflict of interest provisions to permit the non-profit sponsors to be the seller of the land. | |
