Title: Payment or Reimbursement for Emergency Services for Nonservice-Connected Conditions in Non-VA Facilities 
Abstract: The Department of Veterans Affairs (VA) is proposing to amend its regulations concerning emergency hospital care and medical services provided to eligible veterans for nonservice-connected conditions at non-VA facilities. Public Law 106-117 requires VA to pay for the cost of non-VA emergency care for veterans who have no medical insurance and no other means of payment for the care. This is in keeping with CongressÂ’ intent, as reflected in House Report No. 106-237, that this reimbursement and payment authority not cover care that is furnished after the patient's condition has been stabilized. This proposal would amend certain regulations to permit VA to pay or reimburse for the costs of continued, non-emergent hospital care furnished to the veteran beyond the point of stabilization if the veteran requires continued hospital care and requests transfer to VA care but the safe transfer of the veteran cannot be effected due either to the lack of an available hospital bed at a VA facility or other Federal facility or the inability of VA or other Federal facility to accept transfer of the veteran.
