Abstract: Section 217 of the Consumer Product Safety Improvement Act of 2008 (CPSIA), Public Law 110-314, 122 Stat. 3016 (August 14, 2008), requires the Commission to issue a regulation providing its interpretation of the penalty factors described in section 20(b) of the Consumer Product Safety Act (15 USC 2069(b)), section 5(c)(3) of the Federal Hazardous Substances Act (15 USC 1264(c)(3)), and section 5(e)(2) of the Flammable Fabrics Act (15 USC 1194(e)(2)), as amended by the CPSIA. The CPSIA directs that this be accomplished by August 14, 2009. | |
