Title: Amendments to Debt Collection  
Abstract: SBA amended its regulations regarding administrative wage garnishment to clarify terminology within the regulation and to streamline administrative wage garnishment hearing procedures. Specifically, references to “SBA” within 13 CFR section 140.11 are changed to the term “Agency,” defined as the “SBA or any entity, public or private, that pursues recovery of the debt on the SBA’s behalf.” The purpose for this change is to allow Treasury and its contractors to collect debts on behalf of the SBA. Further, 13 CFR section 140.11 is changed such that administrative wage garnishment hearings will be conducted not at SBA’s Office of Hearings and Appeals, but before a Hearing Official designated by SBA. This change will decrease the burden on the appellant because they will not have to prepare for full-fledged litigation.
