Abstract: The Federal Reserve Board (Board) on May 19, 2008, published for comment proposed regulations to amend Regulation DD, which implements the Truth in Savings Act, and the staff commentary to the regulation. The proposed amendments would establish content and timing requirements for a notice to consumers about any right to opt out of and institution's overdraft service. (The substantive requirement to provide an opt-out notice is proposed in a separate proposal under the Federal Trade Commission Act, also published on May 19, 2008 (73 FR 28904)). Requirements for disclosing overdraft fees on periodic statements would be expanded to apply to all institutions and not solely to institutions that promote the payment of overdrafts. The proposed amendments also address the disclosure of account balances provided in response to balance inquiries for consumers. The comment period closed on July 18, 2008. | |
