Title: ●90-Day Finding for a Petition to Revise the Critical Habitat Designation for the Hawaiian Monk Seal | |
Abstract: On July 2, 2008, we received a petition from Center for Biological Diversity, Kahea, and Ocean Conservancy, to revise the critical habitat designation for the Hawaiian monk seal under the Endangered Species Act. The petitioners request that we extend critical habitat in the Northwestern Hawaiian Islands to Sand Island and ocean waters out to a depth of 500 meters and to include key beach areas, sand spits, and islets, lagoon waters, inner reef waters, and ocean waters out to a depth of 200 meters around the main Hawaiian Islands. If all of this habitat is not determined to qualify as critical habitat, the petitioners request that we designate a subset of the petitioned areas. This petition triggers a requirement to make a 90-day finding on whether the petitioned action may be warranted. We have determined that it may be warranted, and we are announcing this finding in the Federal Register. By July 2, 2009, we must make a 12-month determination on whether the petitioned action is warranted and announce how we intend to proceed in the Federal Register. | |
