Title: ●Endangered and Threatened Wildlife and Plants; Designation of Critical Habitat for Roswell Springsnail, Kosters Springsnail, Noels Amphipod, and Pecos Assiminea | |
Abstract: On August 9, 2005, we published a final rule designating critical habitat for four southwestern invertebrates: Roswell springsnail, Koster's springsnail, Noel's amphipod, and Pecos assiminea (70 FR 46304). The four are found at one site in Chaves County, New Mexico; Pecos assiminea is also found at a site in Pecos County, Texas, and a site in Reeves County, Texas. On December 19, 2007, Wild Earth Guardians filed a complaint challenging the merits of our critical habitat designation. Since our February 12, 2002, proposed designation (67 FR 6459), we have received no new information indicating that the species' ranges, habitat requirements, or threats have changed. Thus, we believe our February 12, 2002, proposal is the appropriate starting point for the designation of critical habitat for these species. Therefore, rather than publish a new proposed designation, we will prepare a Federal Register document reopening the 2002 proposal's comment period. | |

Overall Description of Deadline: Under a settlement agreement, we plan to: (1) withdraw the 2005 final rule and reopen the comment period on the original proposed critical habitat rule by March 11, 2009; and (2) submit a new final rule to the Federal Register by July 30, 2010. |
