Title: ●Endangered and Threatened Wildlife and Plants; Determination of Significant Portion of the Range of Marine and Estuarine Areas of the Southwestern Washington/Columbia River Distinct Population Segment 
Abstract: The National Marine Fisheries Service and we jointly published a proposed rule to list the Southwestern Washington/Columbia River Distinct Population Segment (DPS) of coastal cutthroat trout (Oncorhynchus clarki clarki) as threatened under the ESA's DPS provision on April 5, 1999 (64 FR 16397). It was subsequently determined that we alone had jurisdiction. On July 5, 2002, we published a withdrawal of the earlier proposed rule. As a result of litigation and court order, we now reconsider our withdrawal, with specific regard to whether the marine and estuarine areas may constitute a significant portion of the range (SPR) of the Southwestern Washington/Columbia River DPS of coastal cutthroat trout, and if so, whether that portion is threatened or endangered.
