Title: ●Indian Trust Management--Probate: American Indian Probate Reform Act Amendment Updates | |
Abstract: This interim final rule makes changes to the final rule published on November 13, 2008, to incorporate amendments to the American Indian Probate Reform Act that were signed in December 2008. The revisions: (1) state that the Office of Hearings and Appeals has jurisdiction to probate permanent improvements to trust and restricted property; and (2) change the threshold for interests that may be purchased at probate without the consent of heirs and the surviving spouse. This rule is being published as an interim final to ensure that the regulations remain consistent with the statute. | |
