DOL/OSHA RIN: 1218-AC43 Publication ID: Spring 2009
Title: ●Occupational Exposure to Hexavalent Chromium; Final Rule Remand
Abstract: OSHA published a final rule on February 28, 2006 on the Occupational Exposures to Hexavalent Chromium. OSHA was subsequently sued on portions of the rulemaking. The United States Court of Appeals for the Third Circuit remanded the employee notification of exposure results provisions of the Hexavalent Chromium final rule to OSHA for the agency to either provide an explanation for its decision to require notification only where employee exposure exceeds the permissible exposure limit (PEL) or take such further action as may be appropriate. The Agency is currently considering how to respond to the court remand.
