DHS/USCIS RIN: 1615-AB67 Publication ID: Spring 2009
Title: Changes to Requirements Affecting H-2B Nonimmigrants and Their Employers
Abstract: The Department of Homeland Security is amending its regulations affecting temporary nonagricultural workers within the H-2B nonimmigrant category and their U.S. employers. The changes are designed to improve the efficiency and effectiveness of the H-2B nonimmigrant classification. This rule relaxes the current limitations on the ability of U.S. employers to petition unnamed nonagricultural workers to come to the United States. Finally, this rule provides for employer notification to USCIS within 30 days of the date that the employee leaves employment or is terminated. This rule will increase the efficiency of the program by eliminating certain regulatory barriers.
