Title: ●Stay of CAIR and CAIR FIP for Minnesota | |
Abstract: In this action, EPA is proposing to stay the effectiveness, for the State of Minnesota only, of two final rules we issued under section 110 of the Clean Air Act (CAA) related to the interstate transport of pollutants: (1) the May 12, 2005 Clean Air Interstate Rule (CAIR) and (2) the April 28, 2006 backstop CAIR federal implementation plan (FIP). The D.C. Circuit held that EPA, in CAIR and the CAIR FIP, had not properly addressed possible errors in EGU emissions for certain EGUs in Minnesota, and EPA's stated intention to stay the effectiveness of the rules for the State of Minnesota was presented to the D.C. Circuit before it decided to remand rather than vacate the rule. EPA is proposing to stay the effectiveness of these two rules with respect to sources in Minnesota only, while EPA examines the possible errors identified by the court and their potential impact on the inclusion of Minnesota in CAIR. | |
