Title: ●Uniform Criteria for State Observational Surveys of Seat Belt Use  
Abstract: This rulemaking would update the existing criteria, which are found at 23 CFR part 1340, to develop a more uniform criteria. Section 2002 of the Safe, Accountable, Flexible, Efficient, Transportation Equity Act; a Legacy for Users (SAFETEA-LU), Public Law 109-49, provides that the Secretary of Transportation may not approve a State Highway Safety Program which does not provide safety assurances that the State has conducted an annual state wide seat belt survey in accordance with criteria established by the Secretary.
