Title: Dependents Education: Incorporation of Miscellaneous Statutory Provisions 
Abstract: This document amends regulations governing aspects of the SurvivorsÂ’ and DependentsÂ’ Educational Assistance (DEA) program administered by the Department of Veterans Affairs (VA). These amendments reflect provisions of the Veterans Benefits Act of 2003, the Veterans Benefits Improvement Act of 2004, and the Veterans Benefits, Health Care, and Information Technology Act of 2006. The Veterans Benefits Act of 2003 exempted surviving spouses who remarry after age 57 from having their DEA eligibility terminated. The Veterans Benefits Improvement Act of 2004 increased the DEA eligibility period from 10 years to 20 years for a surviving spouse of a serviceperson who died of a service-connected disability while on active duty. The Veterans Benefits, Health Care, and Information Technology Act of 2006 expanded eligibility for DEA to the spouse or child of a serviceperson who is hospitalized or receiving outpatient medical care, services, or treatment and is determined by VA to have a total disability permanent in nature incurred or aggravated in the line of duty and who is likely to be discharged or released from active duty for such disability.
