Abstract: The Commission is considering the issuance of proposed amendments relating to the recordkeeping requirements of futures commission merchants, introducing brokers, and members of contract markets under regulations 1.31 and 1.35. Such proposed amendments would explicitly apply certain record retention and production requirements to e-mails, instant messages, and any other form of written communication created or transmitted electronically.
