Title: ●Children’s Products Containing Lead; Exemptions for Certain Electronic Devices
Abstract: On January 15, 2009, the Commission published a notice of proposed rulemaking (NPRM) concerning exemptions for certain children’s electronic devices unable to meet the lead limits prescribed in section 101(a) of the Consumer Product Safety Improvement Act of 2008 (CPSIA), Public Law 110-314 due to technological infeasibility. On February 12, 2009, the Commission published a notice of withdrawal of the notice of proposed rulemaking on Children’s Products Containing Lead; Exemptions for Certain Electronic Devices issued on January 15, 2009, 74 FR 2435. The Commission instead published an interim final rule on exemptions for certain electronic devices on February 12, 2009. The interim final rule addressed certain electronic devices for which it is not technologically feasible to meet the lead limits as required under section 101 of the CPSIA. The comment period closing date on the interim final rule is March 16, 2009. The Commission staff will review public comments on the interim final rule and prepare a briefing package for Commission consideration.
