Title: Implementation of the Cable Communications Policy Act of 1984 as Amended by the Cable Television Consumer Protection and Competition Act of 1992 | |
Abstract: Section 621(a)(1) of the Communications Act of 1934, as amended, states in relevant part that "a franchising authority ...may not unreasonably refuse to award an additional competitive franchise." The Notice of Proposed Rulemaking (NPRM) solicits comment on implementation of section 621(a)(1)'s directive, and whether the franchising process unreasonably impedes the achievement of the interrelated Federal goals of enhanced cable competition and accelerated broadband deployment and, if so, how the Commission should act to address that problem. The subsequent Report and Order found that certain actions by local franchising authorities constitute an unreasonable refusal to award a competitive franchise within the meaning of section 621(a)(1). The item included a Further Notice of Proposed Rulemaking (FNPRM) seeking comment on how the findings should affect existing franchises. In the Second Report and Order, a number of the rules promulgated in this docket are extended to incumbent cable operators. | |
