Title: Exclusive Service Contracts for Provision of Video Services in Multiple Dwelling Units and Other Real Estate Developments (MB Docket No. 07-51) | |
Abstract: This proceeding was initiated to review the use of exclusive contracts for the provision of video services to multiple dwelling units (MDUs) or other real estate developments. Potential competitors seeking to enter the multichannel video programming distributor (MVPD) marketplace have alleged that the use of exclusive contracts for the provision of video services to MDUs or other real estate developments serves as a barrier to entry. Accordingly, the Notice of Proposed Rulemaking solicited comment on whether the use of exclusive contracts in the MDU video provider market unreasonably impedes the achievement of the interrelated Federal goals of enhanced multichannel video competition and accelerated broadband deployment and, if so, how the Commission should act to address that problem. The Report & Order finds that contractual agreements granting exclusivity to cable operators harm competition and broadband deployment. The Order prohibits the enforcement of exclusivity clauses and the execution of new ones by cable operators. The accompanying Further Notice of Proposed Rulemaking seeks comment on exclusive clauses by providers of DBS and other MVPDs. | |
