Title: Regulation DD--Truth in Savings (Docket No. R-1315) | |
Abstract: The Federal Reserve Board (Board) on May 19, 2008, published for comment proposed regulations to amend Regulation DD, which implements the Truth in Savings Act, and the staff commentary to the regulation. The comment period closed on July 18, 2008, and the Board published a final rule on January 29, 2009 (74 FR 5593). The final rule is effective January 1, 2010. The final rule, which generally adopted the proposed rule with clarifications, requires all depository institutions to disclose aggregate overdraft fees and returned-item fees on periodic statements, and not solely institutions that promote the payment of overdrafts. The final rule also addresses account balance disclosures provided to consumers through automated systems. Finally, the proposed amendments would have established content and timing requirements for a notice to consumers about any right to opt out of an institution's overdraft service. The final rule did not adopt this aspect of the proposed rule. Instead, the Board separately published on January 29, 2009, a proposal under Regulation E, which implements the Electronic Fund Transfer Act, addressing requirements for overdraft services (Docket No. R-1343, 74 FR 5212).
